TERMS AND CONDITIONS 

Small Title

1. DISPUTE SETTLEMENT AND ARBITRATION
Customer and 3J’s Auto Body acknowledge and agree that in the event a dispute or controversy arises concerning this agreement or the repairs to the vehicle, both parties shall first attempt in good faith to resolve the dispute through mediation administered by the American Arbitration Association (AAA) under its applicable Consumer or Commercial Mediation Procedures.


If the matter is not resolved through mediation, the dispute shall be settled by binding arbitration administered by the AAA under its applicable Consumer or Commercial Arbitration Rules. A copy of these rules and procedures is available at www.adr.org, or by contacting the AAA directly. Judgment upon the arbitration award may be entered in any court having jurisdiction.


All arbitration shall be conducted on an individual basis only. Class actions or representative claims are not permitted.
Notwithstanding the above, claims arising under the Magnuson-Moss Warranty Act (MMWA) shall be mediated but not arbitrated. If mediation does not resolve such claims, the Customer may pursue the MMWA claim in court. For any such court action, both Customer and 3J’s Auto Body waive the right to a jury trial.


2. LIMITED WARRANTY
Subject to the terms, conditions, and exclusions outlined below, 3J’s Auto Body warrants repairs against defects in materials and workmanship for the period defined in Section 2(A). During this period, defective work will be repaired or replaced at no cost for parts or labor, subject to the limitations herein.


All warranty repairs must be performed at a 3J’s Auto Body facility unless otherwise approved in advance.


A. Warranty Period; Non-Transferable
This warranty applies only to the original Customer and remains valid for as long as the Customer owns the vehicle, but not less than sixty (60) days. This warranty is non-transferable and non-assignable.


B. Third-Party Parts and Materials
Certain repairs may involve parts or materials supplied by third-party manufacturers. In such cases, 3J’s Auto Body provides warranty coverage only to the extent offered by those manufacturers.


C. Limitations and Exclusions
This warranty does not apply to damage or defects resulting from causes beyond the control of 3J’s Auto Body, including but not limited to:

  • Unauthorized repairs or parts

  • Improper maintenance

  • Misuse, neglect, or abuse

  • Accidents or modifications

  • Subsequent repairs by others (unless approved)

  • Acts of God​

All disputes under this section are subject to the procedures outlined in Section 1.


D. Environmental Damage
This warranty does not cover damage caused by environmental or road conditions, including but not limited to chemicals, tree sap, salt, rocks, hail, weather, or sun exposure.


E. Replaced Parts Ownership
Customer agrees that all parts replaced by 3J’s Auto Body become the property of the shop unless otherwise requested prior to repair authorization.


3. DISCLAIMERS
This Limited Warranty represents the full and complete warranty provided by 3J’s Auto Body and supersedes all prior warranties or representations, whether written or oral.


Except as expressly stated, no other warranties are provided. 3J’s Auto Body shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of use, revenue, or commercial losses.
If any portion of this warranty conflicts with applicable law, such law shall govern.


4. ENTIRE AGREEMENT
Customer acknowledges that no representations or promises have been made outside of this agreement. This document constitutes the entire agreement between Customer and 3J’s Auto Body and supersedes all prior discussions or agreements.


Any modifications must be made in writing and signed by both parties, whether manually or electronically.
